ONTARIO TOXIC REDUCTION ACT (O. REG. 455/09)

The Toxics Reduction Act (TRA) and the toxics reduction regulation (Reg. 455/09) apply to Ontario facilities where manufacturing activities or mineral processing activities take place and the facility is required to provide information under the National Pollutant Release Inventory (NPRI) or Ontario Regulation 127/01 - Airborne Contaminant Discharge Monitoring and Reporting. The purpose of the act is to track toxic substances as they move through facility operations, and to quantify the amount of each toxic substance that is used, created, destroyed, transferred or released in an effort to identify stages or processes at a facility that have the potential to reduce the use and creation of toxic substances.
 
The substances identified as toxic substances in Ontario Regulation 455/09 include all of the substances in the National Pollutant Release Inventory (NPRI) as well as acetone (Reg. 12701).
 
Preparation of the toxic reduction plan is mandatory. Implementation of the toxic reduction plan is voluntary, and progress is tracked through annual reviews and updates.
 
Forty-seven substances and substance groups were identified as priorities for inclusion in the initial regulatory requirements in 2010 and 2011 (Phase 1).
 
Phase 2, which includes all of the remaining substances on the NPRI list, came into effect January 1, 2012. Facilities that use these substances will be required to report and plan for these substances in 2013.
 
Reporting Requirement Dates:
 
January 1, 2010 - Facilities are required to identify, track and quantify all Phase I substances used or created for each process.
 
June 17, 2011 – The first annual report for Phase I substances was due for the prescribed Toxic Substances.
 
June 29, 2012 – The second annual report for Phase I substances was due for the prescribed Toxic Substances.
 
December 31, 2012 – Toxic Substance Reduction Plans for each of the Phase I substances are due. All plans must be signed by a licensed Toxic Reduction Planner.
 
January 1, 2012 – Facilities are required to identify, track and quantify all Phase II substances used or created for each process.
 
June 1, 2013 – The first annual report for Phase II substances is due for the prescribed Toxic Substances.
 
December 31, 2013 – Toxic Substance Reduction Plans for each of the Phase II substances are due. All plans must be signed by a licensed Toxic Reduction Planner.
