CERTIFICATE OF APPROVAL / ENVIRONMENTAL COMPLIANCE APPROVALS

ECAFulco staff has successfully prepared hundreds of Applications for Environmental Compliance Approval (ECA), formerly Certificates of Approval, for Air and Noise emissions as well as Waste Management Systems and Waste Disposal Sites for industrial, commercial, institutional and municipal operations, following all requirements of Ontario Regulation 419/05 - Air Pollution Local Air Quality (O. Reg. 419/05), Otario Regulation 347 - General Waste Management, and the Environmental Protection Act (EPA).
 
Recent amendments to the Environmental Protection Act (EPA) came into effect resulting in a two-path environmental approval process: the Environmental Compliance Approval (ECA) process and the Environmental Activity and Sector Registry (EASR) permit process. The ECA is a new mechanism of environmental approval that replaces the Certificate of Approval (CofA).
 
Air & Noise Emissions:

Section 9 of the Environmental Protection Act states no person shall, except under and in accordance with an Environmental Compliance Approval (ECA) issued by the Ministry of the Environment (MOE):
  • use, operate, construct, alter, extend or replace any plant, structure, equipment, apparatus, mechanism or thing that may discharge or from which may be discharged a contaminant into any part of the natural environment other than water; or
  • alter a process or rate of production with the result that a contaminant may be discharged into any part of the natural environment other than water or the rate or manner of discharge of a contaminant into any part of the natural environment other than water may be altered.
The definition of a contaminant includes noise and vibration. Hence, Section 9 of the Act requires companies or individuals to obtain an ECA (CofA) for contaminant emissions (air and noise) prior to constructing or operating equipment at their facility, if applicable.
 
By February 1, 2010 all facilities that are identified as Schedule 4 facilities, as outlined by O. Reg. 419/05, are required to comply with the air standards in Schedule 3 of O. Reg 419/05 using the more advanced approved air dispersion models (Aermod, ASHRAE, and Screen 3). These facilities must also prepare and annually update an ESDM report.
 
By February 1, 2013 all facilities that are identified as Schedule 5 facilities, as outlined by O. Reg. 419/05, are required to comply with the air standards in Schedule 3 of O. Reg 419/05 using the more advanced approved air dispersion models (Aermod, ASHRAE, Screen 3). These facilities must also prepare and annually update an ESDM report.
 
All other facilities are required to comply with air standards in Schedule 3 using the more advanced approved air dispersion models by February 1, 2020.
 
Most facilities to date still have, or are still operating under, an existing Certificate of Approval issued prior to this change in the regulation using the Appendix to O. Reg. 346 dispersion models to assess compliance. These facilities must evaluate if their approval is still valid or if they are required to update their approval using the new Aermod dispersion model. 
 
Waste Disposal Sites and Waste Management Systems:
 
Section 27 of the Environmental Protection Act states no person shall, except under and in accordance with an Environmental Compliance Approval (ECA) issued by the Ministry of the Environment (MOE):
  • Construct or alter a wast management system or a waste disposal site.
Some types of Waste Disposal sites include but are not limited to thermal treatment sites, waste transfer stations, waste processing sites, composting sites and recycling facilities.
